Welcome to State Medical Equipment. These Terms and Conditions govern your use of our website and purchases of products and services from State Medical Equipment (“SME,” “we,” “us,” or “our”).

By accessing this website, placing an order, making a purchase, or accepting delivery of purchased products or services from SME, you acknowledge and agree to these Terms and Conditions and any additional policies or agreements applicable to your transaction.

Rental transactions are governed separately by the State Medical Equipment Rental Agreement.

You may use this website for lawful personal and commercial purchasing purposes related to the products and services offered by State Medical Equipment.

Website content, including text, graphics, logos, photographs, product information, page designs, and other materials, may not be copied, reproduced, distributed, modified, republished, or commercially exploited without our prior written permission, except as permitted by applicable law.

Unauthorized use of this website, including attempts to interfere with its operation, misuse customer information, engage in fraudulent transactions, or use automated systems to improperly collect website content, is prohibited.

 

PRIVACY & ELECTRONIC COMMUNICATIONS

Your use of this website is also subject to our Privacy Policy.

When you provide an email address or telephone number in connection with an order, purchase, rental, delivery, pickup, service request, or customer-service inquiry, State Medical Equipment may use that information for reasonable communications related to your transaction or request.

PRODUCT INFORMATION

State Medical Equipment makes reasonable efforts to provide accurate product descriptions, specifications, images, availability, and pricing.

However, product information may occasionally contain errors or may change without notice. Product images are provided for general reference and may differ from the exact model, packaging, color, configuration, or accessories provided.

Customers are responsible for confirming the appropriate product, model, size, dimensions, weight capacity, features, compatibility, and other applicable specifications before completing a purchase.

PRESCRIPTION & DOCUMENTATION REQUIREMENTS

Certain medical equipment and supplies may require a valid prescription, physician order, insurance documentation, or other information before they can be provided.

Payment for an item does not eliminate any applicable prescription, documentation, safety, legal, or regulatory requirement.

If required documentation cannot be obtained or verified, State Medical Equipment may delay or cancel the applicable order.

 

PRICING

Prices displayed on our website are subject to change without notice.

If a pricing or website error is discovered before fulfillment, State Medical Equipment may correct the error and contact the customer before proceeding with the order.

We will not charge an increased amount resulting from a pricing correction without appropriate customer authorization.

Taxes, shipping, delivery, setup, assembly, special handling, or other applicable charges may be added when disclosed during checkout, on an invoice, order, or quote.

PAYMENT

Payment is due according to the terms presented when an order is placed.

State Medical Equipment may charge the customer's authorized payment method when an order is submitted or processed.

By providing a payment method, you represent that the payment information is accurate and that you are authorized to use the payment method.

State Medical Equipment will not impose undisclosed charges solely because a payment method is on file.

ORDER ACCEPTANCE

An automated email, text message, receipt, or order confirmation does not guarantee final product availability or fulfillment.

State Medical Equipment may decline, hold, verify, or cancel an order for legitimate business, payment, safety, legal, or regulatory reasons, including product unavailability, pricing errors, suspected fraud, inability to verify payment, missing required documentation, or inability to legally or appropriately provide the requested product.

If State Medical Equipment cancels an order after collecting payment and the applicable product or service has not been provided, the amount collected for that product or service will be refunded.

ALL SALES ARE FINAL

ALL PURCHASES OF MERCHANDISE FROM STATE MEDICAL EQUIPMENT ARE FINAL SALE.

Except as expressly provided in our policies or required by applicable law, State Medical Equipment does not accept returns or exchanges and does not provide refunds after merchandise has been purchased.

This is especially important for medical, hygiene, respiratory, personal-use, special-order, and custom products.

Customers should carefully confirm product specifications, size, compatibility, weight capacity, features, and other requirements before purchasing.

INCORRECT, DAMAGED OR DEFECTIVE PRODUCTS

If you believe State Medical Equipment provided an incorrect product, or a shipped item arrives damaged, incomplete, or materially different from what was ordered, please contact us promptly.

Keep the product, original packaging, shipping carton, labels, accessories, manuals, and other materials until our team provides further instructions.

Manufacturer defects may be subject to the applicable manufacturer's warranty.

State Medical Equipment may assist with manufacturer warranty claims when reasonably possible.

REFUNDS

Because State Medical Equipment maintains an All Sales Final policy, refunds are not provided for ordinary purchases, changes of mind, incorrect customer selections, or discontinuation of use.

A refund may be issued when State Medical Equipment cancels an order before the applicable product or service is provided, charges for an item that cannot be provided, provides an incorrect item and cannot provide the item purchased, or when otherwise required by applicable law.

Services that have already been properly completed—including applicable shipping, delivery, setup, assembly, or expedited-service charges—are generally non-refundable.

SHIPPING

Shipping charges will be disclosed during checkout, on the order, or on the applicable quote whenever reasonably possible.

Oversized, unusually heavy, freight, or special-handling products may require additional shipping charges.

If an additional shipping charge is required that was not previously approved, State Medical Equipment will obtain customer approval before processing the additional charge.

Customers are responsible for providing a complete and accurate shipping address.

LOCAL DELIVERY

State Medical Equipment provides local delivery for eligible products and equipment, subject to product availability, staffing, delivery schedules, location, and other operational requirements.

Applicable delivery charges will be disclosed on the order, invoice, reservation, or quote.

Customers are responsible for providing accurate delivery information and ensuring that an authorized person is available to accept the equipment or merchandise when required.

HOTEL & RESIDENTIAL DELIVERY

For deliveries to hotels or other temporary locations, customers are responsible for providing accurate reservation and delivery information and confirming that the location will accept and hold the equipment or merchandise on their behalf.

State Medical Equipment is not responsible for delays resulting from inaccurate information, hotel policies, restricted access, inability to locate a reservation, or other circumstances outside our reasonable control.

RENTALS

Rental transactions are governed by the separate State Medical Equipment Rental Agreement.

The Rental Agreement governs rental-specific matters including rental periods, charges, cancellations, delivery, pickup, extensions, late returns, equipment condition, cleaning, loss, damage, payment authorization, safe use, and renter responsibilities.

If these Terms and Conditions and the Rental Agreement address the same rental-specific issue, the Rental Agreement will control.

WEBSITE AVAILABILITY

State Medical Equipment makes reasonable efforts to maintain accurate and available website content but does not guarantee uninterrupted or error-free access to the website.

Temporary interruptions may occur because of maintenance, technical issues, third-party services, or circumstances outside our reasonable control.

DISCLAIMER & LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, this website and its content are provided on an “as available” basis.

State Medical Equipment does not guarantee that the website will always be uninterrupted, error-free, or free from harmful components.

To the maximum extent permitted by applicable law, State Medical Equipment is not responsible for indirect, incidental, special, or consequential damages arising solely from the use of or inability to use this website.

Nothing in these Terms excludes or limits any liability or customer right that cannot lawfully be excluded or limited.

CHANGES TO THESE TERMS

State Medical Equipment may update these Terms and Conditions from time to time to reflect changes in our website, products, services, operations, policies, or applicable requirements.

The current version will be posted on this website with the applicable “Last Updated” date.

GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Nevada, except where applicable federal law or another mandatory law controls.

SEVERABILITY

If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed when necessary.

The remaining provisions will continue in full force and effect.
