TERMS AND CONDITIONS

Welcome to State Medical Equipment. These Terms and Conditions govern your use of this website and purchases of products and services from State Medical Equipment ("SME," "we," "us," or "our").

By accessing this website, placing an order, making a purchase, or accepting delivery of purchased products or services from SME, you acknowledge that you have read, understand, and agree to these Terms and Conditions and any additional policy or agreement applicable to your transaction.

Rental transactions are governed separately by State Medical Equipment Rental Agreement.


1. MEDICAL DISCLAIMER

State Medical Equipment is a durable medical equipment supplier.

Product descriptions, specifications, sizing information, educational materials, and other information provided by SME are for general informational purposes and are not intended to replace medical advice, diagnosis, treatment, professional fitting, or clinical judgment.

Customers should consult an appropriate healthcare professional regarding medical conditions, medical necessity, product selection, sizing, compatibility, and safe use when appropriate.

Certain products, equipment, and supplies may require a valid prescription, medical order, or other documentation before they may be provided.

Payment for or placement of an order does not override any applicable prescription, documentation, licensing, safety, or regulatory requirement.


2. PRODUCT AVAILABILITY

All products are subject to availability.

The display of a product on our website does not guarantee that the item is currently in stock.

If an item becomes unavailable after an order is placed, SME may:

  • contact the customer regarding an available alternative;
  • place the item on backorder with the customer's approval; or
  • cancel and refund the unavailable portion of the order.

SME will not substitute a materially different product without customer approval.


3. PRODUCT DESCRIPTIONS, IMAGES, AND SPECIFICATIONS

SME makes reasonable efforts to provide accurate product descriptions, photographs, dimensions, specifications, weight capacities, compatibility information, and pricing.

Manufacturers may change product designs, colors, packaging, components, accessories, or specifications without notice.

Product photographs are for illustration purposes and may differ slightly from the actual product received.

If SME discovers a material error in a product description, specification, availability, or price before fulfillment, SME may contact the customer before completing the order.


4. PRODUCT SELECTION, SIZING, AND COMPATIBILITY

Customers are responsible for reviewing applicable product specifications and confirming that the selected product is appropriate for the intended user and purpose.

Depending on the product, this may include reviewing:

  • patient or user weight;
  • weight capacity;
  • dimensions;
  • seat width and depth;
  • patient height;
  • sling type and sling size;
  • mattress dimensions;
  • wheelchair dimensions;
  • electrical requirements;
  • accessory compatibility;
  • oxygen equipment specifications;
  • mobility-device capacity; and
  • manufacturer operating requirements.

General product information or assistance provided by SME staff does not replace a physician's recommendation, clinical evaluation, professional fitting, therapist assessment, or manufacturer instructions when one is necessary.


5. PRICING

Prices are subject to change without notice.

The applicable price will generally be the price displayed or quoted when the customer places the order, subject to correction of obvious typographical, system, or pricing errors.

If an item is inadvertently listed or quoted at an incorrect price, SME may contact the customer before fulfillment.

The customer may either:

  • approve the corrected price; or
  • cancel the affected item and receive a refund for the amount paid for that item.

SME will not knowingly charge a higher product price than the amount authorized by the customer without obtaining additional authorization.


6. SALES TAX

Applicable sales tax will be collected as required by law.

Customers claiming a tax exemption may be required to provide valid supporting documentation before an exemption can be applied.


7. PAYMENT

Payment is due according to the terms presented at the time the order is placed.

SME may charge the customer's authorized payment method when an order is submitted or processed.

SME will not impose undisclosed charges solely because a payment method is on file.


8. PAYMENT AUTHORIZATION

By providing a credit card, debit card, or other payment method, the person providing the payment information represents that:

  • the payment information is accurate;
  • they are authorized to use the payment method; and
  • SME is authorized to process charges permitted under the applicable transaction.

If a person pays for an order on behalf of a patient, family member, or other individual, the person providing the payment method authorizes the applicable charges associated with that transaction.


9. ORDER ACCEPTANCE

An automated email, text message, receipt, or order confirmation acknowledging receipt of an order does not necessarily guarantee product availability or final fulfillment.

SME may decline or cancel an order for legitimate business, safety, payment, legal, or regulatory reasons, including:

  • product unavailability;
  • pricing or website errors;
  • suspected fraud;
  • inability to verify payment;
  • missing prescription or required documentation;
  • safety concerns;
  • delivery outside SME's applicable service area; or
  • inability to legally or appropriately provide the requested product.

If SME cancels an order after collecting payment and the applicable product or service has not been provided, SME will refund the amount collected for the cancelled product or service.


SALES POLICY

10. ALL SALES ARE FINAL

ALL PURCHASES OF MERCHANDISE FROM STATE MEDICAL EQUIPMENT ARE FINAL SALE.

Except as expressly stated in these Terms or as otherwise required by applicable law, SME does not accept returns or exchanges and does not provide refunds after merchandise has been purchased.

Customers are responsible for confirming the appropriate product, model, size, dimensions, weight capacity, features, compatibility, and other applicable specifications before completing a purchase.

Customers are encouraged to ask any product questions before purchasing.


11. MEDICAL, HYGIENE, AND PERSONAL-USE PRODUCTS

For health, hygiene, infection-control, safety, and resale reasons, medical and personal-use products are final sale.

This includes, but is not limited to:

  • patient lift slings;
  • mattresses;
  • mattress covers;
  • commodes;
  • raised toilet seats;
  • toilet safety equipment;
  • shower chairs;
  • transfer benches;
  • bath safety equipment;
  • cushions and seating surfaces;
  • incontinence products;
  • wound-care products;
  • enteral supplies;
  • respiratory supplies;
  • masks;
  • nasal cannulas;
  • tubing;
  • sterile products;
  • personal-care products; and
  • other products intended for direct patient contact.

These products cannot be returned or exchanged because the customer selected the wrong size, changed their mind, no longer needs the product, or determined after purchase that the product does not meet their personal preference.


12. SPECIAL-ORDER AND CUSTOM PRODUCTS

Special-order and custom products are final sale and non-cancellable once the manufacturer, distributor, or supplier has accepted or begun processing the order.

This includes products that are specifically:

  • ordered for a particular customer;
  • manufactured;
  • configured;
  • programmed;
  • sized;
  • cut;
  • upholstered;
  • modified;
  • assembled; or
  • otherwise obtained or prepared specifically for the customer.

Custom rehabilitation equipment, custom wheelchairs, custom seating systems, and customized accessories are final sale unless otherwise required by applicable law.


13. CUSTOMER CHANGE OF MIND

A change of mind, change in medical circumstances, change in physician recommendation after purchase, inability to use a product, incorrect size or product selected by the customer, personal preference, or no longer needing the equipment does not qualify the purchase for a return, exchange, or refund unless otherwise required by applicable law.

Customers should verify all applicable information before completing their purchase.


14. WRONG ITEM PROVIDED BY SME

If SME provides a product that is materially different from the product shown on the customer's paid invoice or order confirmation because of an SME error, the customer must notify SME promptly.

SME will verify the order and determine the appropriate correction, which may include:

  • providing the correct item;
  • exchanging the incorrect item; or
  • issuing a refund if SME cannot provide the correct item.

The customer should not continue using a product after discovering that it was supplied in error unless SME instructs otherwise.


15. PRODUCT DAMAGED BEFORE OR DURING DELIVERY

Customers should inspect merchandise at the time of delivery whenever reasonably possible.

If merchandise is visibly damaged before or during delivery, the customer should notify SME immediately.

SME may document the condition of the product and determine the appropriate remedy.

Damage occurring after the customer accepts the product is not considered delivery damage unless the customer can reasonably demonstrate that the damage existed at the time of delivery.


16. DEFECTIVE PRODUCTS

A manufacturer's defect is not considered a standard return.

If a customer believes that a product is defective, the customer should contact SME promptly.

Depending on the product, nature of the problem, applicable manufacturer warranty, and applicable law, the remedy may include:

  • troubleshooting;
  • inspection;
  • adjustment;
  • repair;
  • replacement parts;
  • manufacturer warranty service;
  • replacement of the defective product; or
  • another applicable remedy.

A manufacturer's defect does not automatically entitle the customer to a refund when repair, replacement, replacement parts, or manufacturer warranty service is the applicable remedy.


17. MANUFACTURER WARRANTIES

Products may be covered by warranties provided by their respective manufacturers.

Manufacturer warranty periods, exclusions, and remedies vary by product and manufacturer.

Unless SME separately provides an express written warranty, product warranties are those provided by the applicable manufacturer.

SME may assist customers with manufacturer warranty claims when reasonably possible.

Normal wear and tear, accidental damage, misuse, abuse, improper maintenance, unauthorized repairs, unauthorized modifications, and damage caused by failure to follow manufacturer instructions may not be covered by the manufacturer's warranty.

Nothing in these Terms eliminates any legal right that cannot lawfully be waived.


18. REFUNDS

Because SME maintains an All Sales Final policy, refunds are not provided for ordinary purchases, change of mind, incorrect customer selection, early discontinuation of use, or other circumstances covered by the Final Sale provisions above.

A refund may be issued only when:

  • SME cancels an order before the applicable product or service is provided;
  • SME charged the customer for an item that SME cannot provide;
  • SME provided an incorrect item and cannot provide the item actually purchased; or
  • a refund is required by applicable law.

When a refund is authorized, SME will issue the refund to the original payment method whenever reasonably possible.

Shipping, delivery, setup, assembly, expedited delivery, or other services that have already been properly completed are non-refundable unless the charge resulted directly from an SME error or applicable law requires otherwise.

Bank, credit card, or payment processor processing times may affect when an approved refund appears in the customer's account.


SHIPPING AND DELIVERY

19. SHIPPING ORDERS

Shipping charges will be disclosed during checkout, on the order, or on the applicable quote whenever reasonably possible.

Oversized, unusually heavy, freight, or special-handling products may require additional shipping charges.

If an additional shipping charge is required that was not previously approved, SME will obtain customer approval before processing the additional charge.

The customer is responsible for providing a complete and accurate shipping address.

Additional carrier charges resulting from an incorrect address or a customer-requested address change after shipment may be the customer's responsibility.


20. SHIPPED ITEMS THAT ARRIVE DAMAGED OR INCORRECT

Customers should inspect shipped merchandise promptly after receipt.

If a shipped product arrives visibly damaged, incomplete, or materially different from the product ordered, the customer should contact SME promptly.

Customers should retain:

  • the product;
  • original packaging;
  • shipping carton;
  • shipping labels;
  • accessories;
  • manuals; and
  • photographs of visible damage

until SME provides further instructions.

SME will determine the appropriate remedy after reviewing the circumstances.


21. LOCAL DELIVERY

Local delivery is subject to product availability, staffing, delivery schedule, location, and other operational requirements.

The applicable delivery charge will be disclosed on the customer's order, invoice, or quote.

The customer is responsible for providing accurate:

  • delivery address;
  • telephone number;
  • recipient name;
  • access information; and
  • other information reasonably necessary to complete the delivery.

Customers must ensure that someone authorized to accept the merchandise is available when required.


22. DELIVERY TO HOTELS OR OTHER TEMPORARY LOCATIONS

For purchased products delivered to a hotel or other temporary location, the customer is responsible for providing SME with accurate information, including:

  • hotel or location name;
  • complete address;
  • name associated with the reservation;
  • customer's telephone number;
  • arrival date;
  • expected arrival time; and
  • room number when available.

The customer is responsible for confirming that the hotel or location will accept and hold merchandise on the customer's behalf.

SME is not responsible for delays caused by inaccurate information, hotel policies, inability to locate the customer's reservation, restricted access, or other circumstances outside SME's reasonable control.


PRODUCT USE AND REGULATORY REQUIREMENTS

23. SAFE USE OF EQUIPMENT

Customers, patients, caregivers, and other users are responsible for using purchased equipment according to:

  • manufacturer instructions;
  • applicable weight limits;
  • safety warnings;
  • SME operating instructions when provided; and
  • the equipment's intended purpose.

Equipment must not be used in a manner that exceeds the manufacturer's stated specifications.

The customer should discontinue use and seek appropriate service or assistance if equipment appears damaged, unstable, unsafe, or otherwise unsuitable for continued operation.


24. PRESCRIPTION AND DOCUMENTATION REQUIREMENTS

Certain medical equipment and supplies may require a valid prescription, physician order, medical documentation, or other information before SME may provide them.

Customers are responsible for providing requested documentation.

Submission of payment does not waive or override any applicable prescription, documentation, licensing, safety, or regulatory requirement.


25. PRIVATE-PAY AND INSURANCE REIMBURSEMENT

Unless specifically stated otherwise at the time of the transaction, purchases made through SME's online store are private-pay transactions.

Purchasing a product does not guarantee reimbursement from:

  • Medicare;
  • Medicaid;
  • private insurance;
  • employer-sponsored plans; or
  • any other third-party payer.

Customers seeking reimbursement are responsible for confirming coverage, documentation, authorization, and reimbursement requirements with their payer before making a private-pay purchase.


WEBSITE TERMS

26. WEBSITE USE

SME grants users a limited, non-exclusive, and revocable right to access and use this website for lawful purposes.

Users may not:

  • interfere with the operation or security of the website;
  • attempt unauthorized access to another person's account;
  • submit fraudulent orders;
  • misuse payment information;
  • use automated systems to improperly scrape or extract website content;
  • reproduce substantial website content for competing commercial purposes;
  • misuse SME trademarks, logos, photographs, or proprietary content; or
  • use the website for unlawful activity.

27. INTELLECTUAL PROPERTY

Unless otherwise stated, original content created by or for SME, including text, graphics, logos, website design, and other proprietary materials, belongs to SME or its licensors and is protected by applicable intellectual-property laws.

Manufacturer names, trademarks, photographs, product descriptions, logos, and other manufacturer-owned materials remain the property of their respective owners.


28. CUSTOMER ACCOUNTS

Customers are responsible for maintaining the confidentiality and security of their account credentials.

Customers are responsible for providing accurate information and updating information that becomes inaccurate.

SME may suspend or restrict an account reasonably believed to have been compromised, used fraudulently, or used in violation of these Terms.


29. ELECTRONIC COMMUNICATIONS AND AGREEMENTS

By using this website, submitting an online order, electronically accepting applicable terms, or electronically signing an agreement, the customer agrees to conduct the applicable transaction electronically.

Electronic records, acknowledgments, agreements, and signatures may be used to the extent permitted by applicable law.

Customers should retain copies of receipts, order confirmations, invoices, and electronically signed agreements for their records.


30. ORDER AND DELIVERY COMMUNICATIONS

By providing an email address or telephone number in connection with an order or purchase, the customer authorizes SME to use that information for reasonable communications relating to the transaction, including:

  • order confirmation;
  • product availability;
  • payment questions;
  • prescription or documentation requests;
  • delivery coordination;
  • service coordination; and
  • other communications reasonably necessary to complete or administer the transaction.

Marketing communications are subject to any separate consent requirements applicable to those communications.


31. PRIVACY

Personal information collected through this website or in connection with an order is handled according to SME's Privacy Policy and applicable law.

Customers should review the Privacy Policy for additional information regarding SME's collection, use, storage, and disclosure of personal information.


32. WEBSITE AVAILABILITY AND DISCLAIMER

SME makes reasonable efforts to maintain accurate and available website content but does not guarantee that the website will operate continuously without interruption, delay, technical error, or temporary unavailability.

To the maximum extent permitted by applicable law, SME is not responsible for indirect, incidental, special, or consequential damages arising solely from the use of or inability to use this website.

Nothing in these Terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited.


33. PAYMENT DISPUTES AND CHARGEBACKS

Customers are encouraged to contact SME promptly regarding billing questions, unauthorized charges, product concerns, or transaction disputes so that SME has an opportunity to investigate and address the matter.

SME may provide relevant transaction documentation to authorized parties in connection with a payment dispute, suspected fraud, or chargeback, including:

  • payment processors;
  • banks;
  • credit card issuers;
  • financial institutions;
  • insurers;
  • law enforcement; and
  • other parties legally authorized to receive such information.

Transaction documentation may include applicable receipts, invoices, delivery records, signed acknowledgments, service records, communications, and other records relating to the disputed transaction.

Nothing in this section limits a customer's lawful rights with a card issuer, financial institution, or under applicable law.


34. FRAUDULENT TRANSACTIONS

SME reserves the right to refuse, hold, verify, or cancel an order when there is a reasonable concern regarding:

  • fraudulent activity;
  • unauthorized payment;
  • inaccurate customer information;
  • identity or payment verification;
  • misuse of the website; or
  • other suspicious transaction activity.

Additional verification may be requested before an order is fulfilled.


35. RENTAL TRANSACTIONS

Rental transactions are governed separately by State Medical Equipment Rental Agreement.

The Rental Agreement governs rental-specific matters including rental periods, rental charges, cancellation, delivery, pickup, extensions, late returns, equipment condition, loss, damage, cleaning, payment authorization, safe use, and renter responsibilities.

If these Terms and Conditions and the State Medical Equipment Rental Agreement address the same issue in connection with a rental transaction, the State Medical Equipment Rental Agreement of Rental will control.


36. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Nevada, except where applicable federal law or another mandatory law controls.


37. SEVERABILITY

If any provision of these Terms and Conditions is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed when necessary.

The remaining provisions will continue in full force and effect.


38. NO WAIVER

Failure by SME to enforce any provision of these Terms in a particular instance does not constitute a waiver of SME's right to enforce that provision or any other provision in the future.


39. CHANGES TO THESE TERMS

SME may update these Terms and Conditions periodically.

Updated Terms will become effective on the date posted unless another effective date is specifically stated.

Changes will apply prospectively and will not retroactively change the terms applicable to a completed transaction unless permitted by law and agreed to when required.

STATE MEDICAL EQUIPMENT

RENTAL AGREEMENT

 

State Medical Equipment ("SME," "we," "us," or "our")

This Rental Agreement ("Agreement") applies to all durable medical equipment, accessories, components, and related items rented from State Medical Equipment.

By signing this Agreement, electronically accepting it, paying for the rental, or accepting delivery of rental equipment, the Renter or Responsible Party ("Renter") acknowledges that they have read, understand, and agree to the following rental terms.


1. OWNERSHIP OF RENTAL EQUIPMENT

All rental equipment, accessories, components, and related items remain the sole property of State Medical Equipment at all times.

The Renter receives only the temporary right to possess and use the equipment during the approved rental period.

Rental equipment may not be sold, transferred, pledged, subleased, rented to another person, permanently removed from the approved rental location, modified, disposed of, or otherwise transferred without prior authorization from State Medical Equipment.


2. RENTAL PERIOD

The rental period begins and ends on the dates stated on the applicable rental order, invoice, reservation, or rental form.

Rental charges are based on the rental period reserved by the Renter.

The Renter remains responsible for the equipment until it has been:

  • returned directly to State Medical Equipment;
  • picked up by authorized State Medical Equipment personnel; or
  • returned according to specific instructions provided by State Medical Equipment.

Equipment is not considered returned merely because the Renter has stopped using it.


3. EARLY RETURN

THERE ARE NO REFUNDS, CREDITS, OR PRORATED ADJUSTMENTS FOR RENTAL EQUIPMENT RETURNED BEFORE THE SCHEDULED RENTAL END DATE.

Returning equipment early does not convert the rental into a shorter rental period and does not entitle the Renter to a reduced rental rate or refund.


4. RENTAL EXTENSIONS

The Renter must contact State Medical Equipment at least 24 hours before the scheduled rental end date to request an extension.

Rental extensions are:

  • subject to equipment availability;
  • subject to SME approval; and
  • subject to additional rental charges.

An extension is not effective until it has been approved by SME.

The extension charge will be based on the applicable rental rate for the equipment.

Keeping rental equipment beyond the scheduled rental period without SME approval does not constitute an approved extension.


5. LATE RETURNS

If rental equipment is not returned or made available for pickup by the scheduled rental end date and an extension has not been approved, the Renter will be charged the applicable rental rate for the additional period the equipment remains in the Renter's possession or unavailable for pickup.

Late rental charges continue until the equipment is returned to or recovered by State Medical Equipment.

Payment of late rental charges does not transfer ownership of the equipment to the Renter.


6. RETURN OF RENTAL EQUIPMENT

Rental equipment must be returned directly to State Medical Equipment personnel or made available for pickup according to the agreed pickup arrangements.

Unless specifically authorized by SME, rental equipment must not be left:

  • at an airport;
  • with an airline;
  • with a rental-car company;
  • in a hotel room after checkout;
  • in a hotel hallway;
  • with hotel personnel without prior arrangement;
  • outside a residence or building;
  • at another business; or
  • at any unattended or unauthorized location.

Leaving equipment at an unauthorized location does not constitute a proper return.

The Renter remains responsible for the equipment until SME or its authorized representative has recovered it.


7. RENTAL SERVICE AREA

STATE MEDICAL EQUIPMENT PROVIDES RENTAL EQUIPMENT DELIVERY AND PICKUP ONLY WITHIN LAS VEGAS AND HENDERSON, NEVADA.

Rental delivery outside Las Vegas and Henderson is not available unless specifically approved by State Medical Equipment.


8. DELIVERY AND PICKUP

The delivery and pickup charges applicable to the rental will be stated on the rental order, invoice, reservation, or rental form.

The Renter is responsible for providing accurate:

  • delivery address;
  • telephone number;
  • recipient name;
  • access information;
  • hotel information, when applicable; and
  • other information necessary to complete delivery or pickup.

The Renter must ensure that an authorized person is available to accept delivery when required.

If an additional delivery or pickup trip is required because of circumstances caused by the Renter, an additional trip charge may apply according to the delivery or pickup rate disclosed on the rental order.

Examples include:

  • nobody being available to accept delivery;
  • inability to obtain access;
  • incorrect delivery information;
  • incorrect hotel information;
  • customer-requested redelivery;
  • equipment being unavailable for scheduled pickup;
  • change of hotel;
  • change of delivery or pickup location; or
  • customer-requested additional trips.

9. HOTEL RENTALS

For hotel deliveries and pickups, the Renter is responsible for providing accurate:

  • hotel name;
  • hotel address;
  • reservation name;
  • telephone number;
  • arrival date;
  • expected arrival time;
  • departure date;
  • room number when available; and
  • any other information required to complete delivery or pickup.

The Renter is responsible for confirming that the hotel will accept, store, release, and permit pickup of rental equipment.

Rental equipment must not be left in a hotel room after checkout unless specific pickup arrangements have been approved by SME.

If equipment cannot be retrieved because it was left under an incorrect guest name, moved from the hotel, placed in an inaccessible location, left after checkout without approved arrangements, or otherwise made unavailable for pickup, the Renter remains responsible for the equipment and applicable rental, retrieval, loss, or replacement charges.


10. CONDITION OF EQUIPMENT AT DELIVERY

The Renter should inspect the rental equipment at the time of delivery or receipt.

Unless otherwise documented, acceptance of the equipment acknowledges that the equipment was received in reasonably clean, complete, and functional condition.

The Renter should promptly notify SME of any:

  • visible damage;
  • missing components;
  • operational problems;
  • unusual noises;
  • instability;
  • electrical problems; or
  • other apparent defects.

11. RENTER RESPONSIBILITY FOR EQUIPMENT

The Renter agrees to exercise reasonable care while the rental equipment is in the Renter's possession or control.

The Renter is responsible for loss of or damage to rental equipment resulting from:

  • misuse;
  • abuse;
  • neglect;
  • improper operation;
  • dropping or impact;
  • liquid damage;
  • improper storage;
  • improper transportation;
  • unauthorized repair;
  • unauthorized modification;
  • theft;
  • loss;
  • missing parts or accessories;
  • use exceeding manufacturer specifications;
  • use exceeding stated weight capacity; or
  • failure to follow manufacturer or SME instructions.

The Renter is not responsible for ordinary and reasonable wear and tear caused by normal intended use.


12. DAMAGE TO RENTAL EQUIPMENT

If rental equipment is damaged beyond ordinary wear and tear, the Renter is responsible for the reasonable cost of:

  • inspection;
  • replacement parts;
  • labor;
  • repair; and
  • replacement of missing or damaged components.

If the equipment cannot reasonably be repaired or the cost of repair is commercially unreasonable, the Renter may be charged the replacement value of the equipment.

State Medical Equipment may document or photograph the condition of rental equipment before delivery and after return.


13. LOST, STOLEN, DESTROYED, OR UNRETURNED EQUIPMENT

The Renter is responsible for protecting rental equipment against loss, theft, destruction, abandonment, and unauthorized removal.

If equipment is lost, stolen, destroyed, abandoned, not returned, unavailable for recovery, or damaged beyond reasonable repair, the Renter will be responsible for the replacement value of the equipment and applicable accessories.

The applicable replacement value should be shown on the rental order, invoice, rental form, or equipment schedule.

Rental charges incurred before the equipment is recovered or determined to be lost may also remain due.

If equipment is stolen, SME may require the Renter to provide a police report or other reasonable documentation.


14. MISSING PARTS AND ACCESSORIES

The Renter is responsible for returning all accessories and components supplied with the rental equipment.

These may include:

  • chargers;
  • batteries;
  • power cords;
  • hand controls;
  • slings;
  • footrests;
  • leg rests;
  • cushions;
  • trays;
  • oxygen accessories;
  • cables; and
  • other equipment-specific components.

Missing items may be charged at their replacement cost.


15. CLEANING AND SANITATION

Rental equipment must be returned in reasonably clean condition consistent with ordinary use.

A $50.00 excessive-cleaning fee will be charged when rental equipment is returned in a condition requiring cleaning or sanitation substantially beyond SME's normal rental-equipment cleaning process.

Examples include excessive:

  • bodily fluids;
  • food or beverage contamination;
  • smoke residue;
  • pet contamination;
  • mud;
  • adhesive residue;
  • biological contamination; or
  • unusually heavy soiling.

The $50.00 fee does not apply to ordinary cleaning and sanitation normally performed by SME between rentals.


16. SAFE USE OF RENTAL EQUIPMENT

The Renter, patient, caregiver, and anyone operating the equipment are responsible for using the equipment:

  • only for its intended purpose;
  • according to manufacturer instructions;
  • within applicable weight limits;
  • according to safety warnings;
  • according to SME operating instructions when provided; and
  • only when the operator understands how to safely use the equipment.

Rental equipment must not be used beyond the manufacturer's specifications or intended purpose.


17. PATIENT LIFTS AND SLINGS

When renting a patient lift, the Renter acknowledges that safe operation requires:

  • an appropriate sling;
  • correct sling size;
  • compatibility between the sling and lift;
  • proper patient positioning;
  • proper sling attachment;
  • compliance with patient and equipment weight limits; and
  • an operator who understands the transfer procedure.

The Renter must confirm whether the patient already has a compatible sling or whether a sling must be obtained separately.

The Renter, patient, caregiver, and applicable healthcare professional are responsible for confirming the appropriate sling type, sling size, patient weight, lift capacity, sling capacity, attachment points, positioning, and transfer technique.

A patient lift must never be used beyond the manufacturer's stated weight capacity.

A damaged, torn, excessively worn, improperly sized, or incompatible sling must not be used.


18. NO UNAUTHORIZED REPAIRS OR MODIFICATIONS

The Renter must not dismantle, modify, alter, reprogram, repair, or allow an unauthorized third party to repair SME rental equipment.

If equipment appears damaged or malfunctioning, the Renter must discontinue use when continued operation may be unsafe and contact State Medical Equipment.


19. EQUIPMENT MALFUNCTION

If rental equipment appears damaged, unstable, unsafe, or malfunctioning, the Renter must:

  1. discontinue use when continued use could create a safety risk; and
  2. promptly contact State Medical Equipment.

SME will determine the appropriate response, which may include:

  • troubleshooting;
  • inspection;
  • adjustment;
  • repair;
  • replacement;
  • substitute equipment; or
  • other appropriate action.

Replacement or substitute equipment is subject to availability.

The Renter must not continue using equipment that appears unsafe.


20. RENTAL CANCELLATION POLICY

A rental reservation may be cancelled without a cancellation fee when State Medical Equipment receives the cancellation at least 24 hours before the scheduled delivery time.

A cancellation received less than 24 hours before the scheduled delivery time, including a same-day cancellation, is subject to a cancellation fee equal to 20% of the total rental order amount.

If the rental equipment has already been dispatched or is out for delivery at the time a cancellation is received, any applicable delivery or transportation charge is non-refundable. This applies in addition to any cancellation fee otherwise due under this Rental Agreement.

Once rental equipment has been delivered or accepted by the Renter, patient, caregiver, family member, hotel, or another authorized recipient, the transaction is no longer considered a cancellation.

The rental charges and early-return policy will then apply.


21. PAYMENT AUTHORIZATION

Payment may be collected when the rental reservation or order is submitted or processed.

By providing a credit card, debit card, or other payment method, the person providing the payment method represents that:

  • the payment information is accurate;
  • they are authorized to use the payment method; and
  • SME is authorized to process charges properly due under this Rental Agreement.

The Renter authorizes State Medical Equipment to charge the payment method on file for applicable:

  • rental charges;
  • approved rental extensions;
  • late rental charges;
  • 20% cancellation fees;
  • additional delivery or pickup services;
  • $50 excessive-cleaning fees;
  • renter-caused equipment damage;
  • missing parts or accessories;
  • lost, stolen, destroyed, or unreturned equipment; and
  • replacement costs.

SME will not impose charges that are not authorized by this Rental Agreement or otherwise agreed to by the Renter.


22. PAYMENT METHOD ON FILE

The Renter agrees to maintain a valid payment method during the rental period.

Expiration, cancellation, replacement, suspension, or closure of a payment card does not eliminate amounts otherwise due under this Rental Agreement.

If the payment method becomes invalid, the Renter agrees to provide another valid payment method upon request.


23. ASSUMPTION OF RESPONSIBILITY AND RISK

The Renter acknowledges that durable medical equipment must be properly selected, fitted where applicable, and operated according to manufacturer instructions.

Use of equipment may create risks if it is:

  • improperly used;
  • improperly fitted;
  • overloaded;
  • operated by an individual who does not understand safe operation;
  • used with incompatible accessories;
  • modified;
  • damaged; or
  • used contrary to instructions.

The Renter assumes responsibility for risks resulting from improper use, misuse, unauthorized modification, failure to follow instructions, or operation of rental equipment outside its intended purpose by the Renter, patient, caregiver, or another user.


24. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, State Medical Equipment will not be responsible for injury, death, property damage, loss, or other damages resulting from:

  • misuse or abuse of rental equipment;
  • failure to follow manufacturer instructions or warnings;
  • failure to follow SME instructions;
  • operation beyond stated weight or performance limits;
  • use of incompatible accessories;
  • improper patient positioning;
  • improper sling selection or attachment;
  • improper transfer technique;
  • unauthorized repair or modification;
  • operation by a person who does not understand how to safely use the equipment;
  • continued use after equipment appears damaged, unsafe, or malfunctioning;
  • acts or omissions of the Renter, patient, caregiver, or another third party; or
  • use of equipment for a purpose for which it was not designed.

Nothing in this Rental Agreement excludes or limits liability that cannot lawfully be excluded or limited.


25. MEDICAL RESPONSIBILITY

Rental of medical equipment does not constitute medical advice, diagnosis, treatment, physical therapy, occupational therapy, professional patient assessment, or determination of medical necessity.

The Renter, patient, caregiver, and healthcare provider remain responsible for determining whether the rented equipment is appropriate for the patient.

Customers should consult an appropriate physician, therapist, or healthcare professional when necessary regarding equipment selection, sizing, transfer technique, and safe use.


26. PRESCRIPTION AND DOCUMENTATION REQUIREMENTS

Certain equipment may require a valid prescription, physician order, medical documentation, or other information before State Medical Equipment may provide it.

Payment for or reservation of equipment does not waive or override applicable prescription, documentation, licensing, safety, or regulatory requirements.


27. PERSONAL PROPERTY

State Medical Equipment is not responsible for personal belongings left on, inside, attached to, or transported with rental equipment.

The Renter is responsible for removing all personal belongings before equipment is returned or picked up.


28. FAILURE TO RETURN EQUIPMENT

Rental equipment remains the property of State Medical Equipment.

If the Renter fails to return equipment after the rental period expires and does not cooperate with reasonable recovery efforts, State Medical Equipment may take lawful steps to recover its equipment and collect amounts properly due under this Rental Agreement.


29. COMMUNICATIONS

By providing a telephone number or email address in connection with the rental, the Renter authorizes State Medical Equipment to use that information for reasonable communications concerning:

  • rental confirmation;
  • delivery;
  • hotel coordination;
  • pickup;
  • rental extensions;
  • payment;
  • equipment condition;
  • service;
  • overdue equipment;
  • documentation; and
  • other matters necessary to administer the rental.

30. GOVERNING LAW

This Rental Agreement is governed by the laws of the State of Nevada, except where applicable federal law or another mandatory law controls.


31. SEVERABILITY

If any provision of this Rental Agreement is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed when necessary.

The remaining provisions will continue in full force and effect.


32. ENTIRE RENTAL AGREEMENT

This Rental Agreement, together with the applicable rental order, invoice, rental form, equipment schedule, and any specifically incorporated written terms, constitutes the agreement governing the rental transaction.

Any approved change to the rental dates, equipment, delivery location, or charges should be documented by State Medical Equipment.


33. RENTER ACKNOWLEDGMENT

By signing below, the Renter or Responsible Party acknowledges that:

  • they have read and understand this Rental Agreement;
  • the applicable rental period and charges are understood;
  • all rental equipment remains the property of State Medical Equipment;
  • the Renter is responsible for proper care and return of the equipment;
  • the Renter understands the cancellation policy;
  • the Renter understands that there are no refunds or prorated credits for early return;
  • the Renter understands the safe-use responsibilities;
  • the Renter understands responsibility for lost, stolen, damaged, or unreturned equipment;
  • the Renter understands and agrees to the payment authorization; and
  • the Renter agrees to comply with this Rental Agreement.
